1. Acceptance of Terms; E-Signature
By creating an account, clicking "I Agree," or using Domesta's platform (the "Service"), you agree to these Terms, including the Liability Waiver (§12) and the GCC & MENA Regional Addendum (where applicable). You must be 18+ and able to form a binding contract. Your electronic acceptance is the legal equivalent of your handwritten signature.
2. Definitions
- Helper: An individual offering domestic worker services through the Service. Previously and equivalently referred to as a "Worker," and described as a "Domestic Worker" where applicable law, regulation, or industry standards use that term.
- Household: An individual or entity seeking domestic worker services through the Service. Previously and equivalently referred to as a "Customer" or "Employer." Where an engagement proceeds, the Household — not Domesta — is the employer of the Helper for the purposes of any applicable employment or labour law.
- Agent: A licensed recruitment/manpower agency (where permitted).
- Subscription: A recurring, auto-renewing paid plan.
- Off-Platform: Any engagement or payment conducted outside the Service after discovery on Domesta.
3. What Domesta Is (and Is Not)
Domesta is a technology marketplace connecting Households, Helpers, and, where applicable, Agents. Domesta is not an employer, sponsor, recruiter, agent, or insurer; does not control working conditions; does not process wage payments; and is not a party to any employment contract. Users are solely responsible for complying with applicable labor, immigration, tax, and licensing laws.

5. User Responsibilities & Acceptable Use
- Violate laws; harass, discriminate, or defraud; or upload illegal content.
- Solicit, promote, facilitate, or engage in human trafficking, forced labor, prostitution/sexual services, child exploitation, or recruitment of minors.
- Scrape, harvest, or misuse personal data or content; bypass fees; circumvent safety controls; or engage in spamming/marketing outside legitimate engagement.
6. Fees, Payments, Taxes; Escrow; Refunds
7. Subscriptions: Auto-Renew, Cancellation, Fee Changes
Subscriptions auto-renew; you may cancel anytime effective at the end of the period. Material price changes require at least 30 days' notice.
8. Service-Specific Refunds & Disputes (Non-Subscription)
As stated in §6.4, a Household may request a refund within 24 hours if the service fails to meet described standards or due to proven Helper misconduct. Domesta's decision is final, subject to mandatory local law.
9. Your Content & License
You retain ownership of your content. You grant Domesta a license to host, process, reproduce, display, and create derivative works solely to operate the Service.
Job posts. Job posts are for households hiring domestic help only — no commercial advertisements, nothing for sale, and nothing unlawful. Every post is reviewed before it is published, and Domesta may decline, edit-request, or remove a post at its discretion. Domesta hosts job posts; any hiring agreement is between the household and the helper. When a helper applies to a job post, they consent to sharing their contact details with that household as part of the application.
10. Safety, Screening & Due Diligence
We may offer identity/document verification via third parties. Verification does not guarantee identity, legality, conduct, or outcomes. Users must perform their own due diligence. (We may cooperate with authorities as noted in §5.7.)
11. Availability, Changes & Maintenance
We may modify, suspend, or discontinue features at any time. The Service depends on third-party networks/providers; outages or delays may occur.

Our Privacy Policy explains how we collect, use, share, and protect personal data.
14. Sanctions & Export Controls
You are not in a comprehensively sanctioned jurisdiction or on applicable sanctions lists; you will not use the Service in violation of sanctions/export laws. We may suspend/terminate for violations.
15. IP Infringement (DMCA-Style) & Content Moderation
If you believe content infringes your rights, email info@domesta.com with contact details, the work and infringing material (URL/screenshots), and a statement under penalty of perjury that use is unauthorized. We may remove content and terminate repeat infringers.
16. Electronic Signatures & Communications
You consent to contract electronically and receive notices electronically (in-product, email, and where provided, SMS/WhatsApp). Marketing requires opt-in.
17. Assignment; Third-Party Services; reCAPTCHA
You may not assign these Terms without our consent. Domesta may assign in a merger, acquisition, or asset sale. Use of third-party services is subject to their terms/privacy.
18. Force Majeure
We are not liable for delays/failures due to events beyond reasonable control.
19. Governing Law; Informal Resolution; Arbitration; Carve-Outs
Delaware law governs (conflicts rules excluded). Before arbitration, email a Notice of Dispute to info@domesta.com; the parties will try to resolve in 30 days. If unresolved, disputes will be resolved by final and binding arbitration administered by AAA (Commercial Rules) in New York, NY, in English. Either party may bring an individual claim in small-claims court or seek injunctive/equitable relief to protect IP or prevent scraping/fraud. You may opt out of arbitration within 30 days of first acceptance by emailing info@domesta.com. Class actions are waived. Proceedings are confidential except as needed to enforce or as required by law.
20. Amendments; Severability; No Waiver; Entire Agreement; Time to Bring Claims
We may amend these Terms; material changes will be communicated and may require reaffirmation at next login. If any provision is invalid, the remainder remains in effect. Failure to enforce is not a waiver. These Terms are the entire agreement regarding the Service. Any claim must be filed within one (1) year after it accrues.
21. Order of Precedence; Governing Language; Survival
Order-form/plan terms (if any) control, then these Terms, then policies (including the Privacy Policy and the GCC & MENA Addendum).

Notices to you may be in-product or by email. Notices to Domesta must be sent to info@domesta.com and by post to the registered address.

GCC & MENA Regional Addendum
Effective Date: August 21, 2025
Applies To: Users located in, or engaging services connected to, the GCC and wider MENA region (including Bahrain, United Arab Emirates, Kingdom of Saudi Arabia, Jordan, Qatar, Oman, Kuwait, Egypt, Lebanon, and Morocco).
1. Local Law Precedence
In the event of conflict between these Terms and mandatory local laws (including labor, immigration, and consumer protection regulations) of the jurisdiction where services are provided or performed, the local laws shall prevail to the extent required.
2. Labor & Immigration Compliance
- Domesta is a technology platform only and does not act as an employer, sponsor, or manpower agency.
- All Households, Helpers, and Agents are solely responsible for compliance with:
- Domestic worker laws and regulations (e.g., Bahrain's LMRA Act 19/2006, UAE Federal Law No. 10/2017, Saudi worker Regulations 2013, Jordanian Labor Law, Moroccan Labor Code, Egyptian Labor Law).
- Immigration, sponsorship, and visa requirements.
- Wage protection and contract registration systems (where applicable).
3. Recruitment Fee Ban
No Helper shall be charged any recruitment, placement, or processing fee in violation of applicable law. Households and Agents acknowledge sole responsibility for any breach. Domesta reserves the right to suspend or terminate violators immediately.
4. Refunds & Disputes (Regional)
In addition to Section 8 of the Terms:
- Households in GCC/MENA countries may be entitled to refunds under mandatory consumer protection rules.
- Domesta will process refunds in line with applicable laws of the jurisdiction where the service occurred.
- Domesta's discretionary authority under Section 8 is limited where mandatory consumer rights apply.
5. Liability & Waiver (Regional Adjustment)
- Nothing in Section 12 shall exclude liability for gross negligence, fraud, or willful misconduct under applicable GCC/MENA law.
- Domesta's liability cap (fees paid in the last 6 months) remains valid except where prohibited by local statutes.
- Domesta does not assume liability as an employer, recruiter, or sponsor of any Helper.
6. Insurance
- Domesta does not provide insurance.
- Households are strongly advised to obtain domestic helper insurance or equivalent coverage where required (e.g., UAE, KSA mandatory helper coverage; optional worker injury/property insurance in Egypt, Lebanon, Morocco).
7. Dispute Resolution (Regional)
- For disputes arising in GCC/MENA jurisdictions, parties shall first attempt amicable settlement.
- If unresolved, disputes may be brought before the competent courts of the jurisdiction where the services were provided.
- Arbitration in New York (per Section 19) may still apply for cross-border disputes where enforceable, but does not limit mandatory local jurisdiction.
8. Survival
Sections 2, 3, 5, 6, and 7 of this Addendum survive termination of the Terms.
Acknowledgment
By using Domesta in GCC or MENA jurisdictions, you agree to comply with this Regional Addendum in addition to the general Terms of Service.
